An individual who had not accepted breaking up with his ex broke into her residence in Montreal and assaulted three persons, including the lady and her new partner.
The individual was charged with breaking and entering (Section 348 of the Criminal Code), an offence liable to imprisonment for life, as well as assault (Section 266 of the Criminal Code).
He asked Laurent Morin from the law firm of Cormier Simard to help him with in this situation. The client acknowledged his guilt, and the evidence against him left no room for any doubt. Therefore, he had to find a way to avoid going to prison, possibly without incurring a criminal record.
Mr Morin first negotiated with the Prosecutor to withdraw the more serious charge, breaking and entering. Then the client pleaded guilty to
assault, and our criminal lawyer asked the Judge to order writing a presentence report.
During the submissions, our lawyer highlighted the positive points in the presentence report and requested the Judge grant the client a conditional discharge.
The Judge found this suggestion reasonable and implemented it in the case of the defendant.
