An individual was arrested by the police after breaking a mail box and then driving away recklessly. He was charged with dangerous driving under Section 249 (1)a) and (2)b) of the Criminal Code (now section 320.13 of the Criminal Code) and mischief under $ 5,000 (Section 430 (1) a) and (4)b) Criminal Code). He hired a criminal lawyer from our firm, Mr Luc Simard. The client acknowledged the facts, but wished to avoid having a criminal record, given his situation as a student.
Negotiations took place with the Crown Prosecutor. The lawyers suggested to the Judge that the client be given a conditional discharge subject to carrying out community work. The Judge granted the client the discharge.
Not all Mr Luc Simard’s clients receive a discharge. See notice.
