In the Montreal district, a motorcycle operator was charged with driving dangerously for the public, under Section 249(1)a) (2)b) of the Criminal Code (now section 320.13 od the criminal code) and not stopping his vehicle while being chased by a police officer in order to escape, under Section 249.1 (1) (2) b) of the Criminal Code. Using radar supervision on the side of the highway, a police officer aboard a motorcycle had read the motorcyle rider and his companion driving at approximately 150 km/h.
The police officer decided to chase the two motorcycles. The defendant supposedly kept going, zigzaguing between vehicles at speeds reaching 240 km/h. The policeman could not read the license plate behind the motorcycle, because a pivot kept it in place horizontally to prevent it being read. Also, the defendant accelerated out of sight of the police officer. The cyclist was identified a few minutes later, when an accident caused him very serious injuries. When the defendant pleads guilty, the SAAQ normally provides for a minimum suspension of the driver’s license for one year for reckless driving, and four years for escaping arrest. Mrs. Anne-Sophie Cogné negotiated wth the Prosecutor so a delay of procedures be declared relative to the charges in exchange for a prohibition of two years, which avoided the defendant losing his license for two years. The defendant also benefited from a longer delay to pay the fine.
