The police arrested an individual on the highway for a Highway Safety Code offence. The police officer immediately noticed a hunting rifle lying on the back seat, and then found ammunition on the front seat. The individual was charged with carrying and storing a weapon and ammunition in a negligent manner (Section 86 of the Criminal Code). He hired Mr Xavier Cormier in Montreal to defend him.
After our criminal lawyer appeared in court and analysed the case, he concluded the client was guilty on at least one of the two counts. However, the client had to avoid getting a criminal record, because he owned a special permit that could have been revoked in case of a conviction.
An agreement was therefore negotiated with the Prosecutor so that one of the two charges would be withdrawn and that the client benefit from an absolute discharge on the second count. Once the client pleaded guilty, the Judge accepted this agreement and the client therefore will not have any record.
