After the Montreal police entered the residence of a soldier who was a member of the Canadian Armed Forces, the latter faced five charges, including threats to destroy property (Section 264.1 (1) b) (3) b) Criminal Code), death threats, wilful obstruction of a peace officer (Section 129 Criminal Code) and mischief (Section 430 Criminal Code). He asked one of our criminal lawyers to defend him, in order to save his career within the Armed Forces.
Criminal lawyer Xavier Cormier asked the client to gather certain documents about his psychological condition and his career. Negotiations were undertaken with the Prosecutor to avoid the client landing a criminal record. Three of the charges were dropped by the Crown.
However, the Prosecutor did not agree with the defence’s proposal to grant a discharge to the defendant. Therefore, we had to plead for the client before the Judge. The latter agreed with the defence’s arguments, and the defendant received an absolute discharge.
