A client was arrested while exiting a store after stealing over $ 100 worth of goods. She was charged with shoplifting and possession of stolen goods (Section 334 b)ii) of the Criminal Code and 354(1)a) and 355b)ii) of the Criminal Code). This client had already been found guilty of theft about 6 years prior. She had then received a first discharge.
The client hired criminal lawyer Xavier Cormier to represent her because she really had to receive a second discharge. She often had to travel to the United States for work reasons.
Now, it is difficult to receive a discharge a second time. The Prosecutor asked the Judge to give the client a criminal record. In Mr Cormier’s plea to the Judge, he mentioned the fact that the client had paid back the store and made charity donations, had undergone psychological follow-ups as well as other factors. After listening twice to the attorneys’ arguments, the Judge finally agreed with the defense’s suggestion and granted the client an absolute discharge.
