Charges of sexual assault causing bodily harm had been laid on a client of Mr. Luc Simard (Section 272 (1) c) and (2) b) Criminal Code). The client acknowledged the facts, but wished to avoid a prison sentence.
Therefore, Mr Simard requested the drafting of a pre-sentencing report that would explain to the Judge what type of person the client was. Then Mr Simard negotiated with the Prosecutor. They reached an agreement whereby the client would carry out 240 hours of community work and would undergo probation. The Judge accepted the lawyers’ suggestion and Mr Simard’s client was not sent to prison.
