Several neighbours of one of criminal lawyer Xavier Cormier’s clients made complaints of criminal harassment to the police (Section 264 (1) (3) b) Criminal Code). After the Prosecutor studied the case, the client faced two cases: one criminal charge of harassing two neighbours, as well as a request for a peace bond filed by two other neighbours (Section 810 Criminal Code). Not only the client did not admit committing the allegated actions,
but he claimed the neighbours might have plotted against him to lay charges.
Mr Cormier asked the Judge to take the criminal harassment case to court and to set a date for a hearing concerning the peace bond. During the harassment trial held in November 2014, Mr Cormier cross-examined the neighbours about some contradictions between their testimony and their previous statements. Mr Cormier’s client also testified. The Judge decided that there was not sufficient evidence to find the client guilty in this case and acquitted him. As for the peace bond hearing, Mr Cormier negotiated with the Prosecutor, who withdrew the complaint against Mr Cormier’s client, who was therefore discharged.
