An incident happened in Montreal in front of the bar where the client of criminal lawyer Christos Karteris was working that evening. The victim claimed the bouncer was in a rage and punched him in the face, thereby causing him bodily harm. An independent witness who was present confirmed this version of the story. Therefore, charges of assault causing bodily harm were laid (Section 267 b) Criminal Code).
Our lawyer requested holding a preliminary investigation in order to assess the witnesses’ credibility and ask them strategic questions to prepare for the trial. Then there was a two day trial during which the Prosecutor had four civilian witnesses and two police officer witnesses take the stand. Mr Karteris cross-examined them mainly to raise doubt about how reliable their testimony was in identifying the defendant as the person who threw the punch. Afterwards, he had his client and a colleague of the latter testify as defence witnesses. Mr Karteris pleaded that the evidence was not reliable, mentioning for example that during a boxing match it is very difficult to see exactly when a blow is made.
The Judge acquitted the client of our criminal lawyer. Not all Mr Karteris’s clients are acquitted. See notice.
